The Ministry of Human Resources and Social Development (MHRSD) in Saudi Arabia has announced plans to implement mandatory occupational fitness testing for employees across government, private, and non-profit sectors. This initiative aims to ensure that employees are physically and psychologically fit to perform their duties safely and efficiently. The proposed regulations are currently available for public consultation on the Istitlaa platform, inviting feedback from stakeholders before enforcement.

Types of Occupational Fitness Tests

  • Psychological Testing: Assesses mental health and cognitive function.

Applicability of the Regulations

These regulations apply to all employees and new hires in public, private, and non-profit sectors under specific occasions, including:

  • Post occupational injury.
  • After returning from long medical leave.
  • When there is doubt about the employee’s ability to perform duties.
  • If the role requires periodic medical exams.
  • Upon changing professions or work environments.
  • When using new equipment or machinery.
  • Upon retirement if exposed to long-latency hazards like asbestos.

Implementation and Oversight

The medical exams must be conducted by a specialized team under the supervision of an occupational medicine expert certified by the Saudi Commission for Health Specialties and registered with the National Council for Occupational Safety and Health.

Outcomes of the Medical Examination

  • Medically Fit: Allowed to work in the designated job role.
  • Medically Fit with Restrictions: Allowed to work with specified conditions or for a defined duration.
  • Medically Unfit: Not allowed to work in the applied role.

Employees who are declared unfit during periodic exams will be reassigned to other roles by management.

Right to Appeal

Employees can object to results within 30 days. An independent committee, consisting of medical and occupational experts, will review the case and issue a decision within 15 days.
