Saudi Arabia Imposes SR50,000 Fine For Misuse Of Temporary Hajj And Umrah Work Visas

Saudi Arabia has introduced strict penalties of up to SR50,000 for the misuse of temporary work visas associated with services during the annual Hajj pilgrimage and Umrah. The penalties come under newly approved rules to regulate visa use.

Penalties for Violations

  • Fine: A maximum fine of SR50,000 will be imposed on violators.
  • Ban: Offenders could also face a five-year ban from applying for temporary Hajj and Umrah work visas.
  • Payment Obligation: Violators must repay the earnings gained through misuse of the visa.

The violations include selling, transferring, or using the visa for purposes other than the approved activities during Hajj and Umrah seasons.

Additional Fines and Requirements

In cases where the applicant's address, documents, or submitted data are found to be incorrect, they will face a fine of up to SR15,000.

Financial Guarantee Requirement

The updated regulations require applicants to provide a financial guarantee of SR2,000 per worker to cover potential repatriation costs. This guarantee will be refunded upon proof of the worker's departure from Saudi Arabia.

Temporary Work Visa Duration

The temporary work visa for Hajj and Umrah services allows the holder to stay in the kingdom for 90 days from the date of entry. The visa can be extended for an additional 90 days by the Ministry of Hajj and Umrah. The visa holder must leave the kingdom before the end of the extended period.

Restrictions on the Visa

  • The visa does not permit the holder to perform Hajj.
  • The temporary visa cannot be converted to a visa for permanent or other temporary work.

Regulatory Changes and Market Flexibility

Earlier this month, the Saudi government approved new regulations for temporary labour visas. The updated rules are intended to offer flexibility to the private sector, enabling it to meet its labour needs during peak seasons such as Hajj and Umrah.

The Ministry of Human Resources emphasized that the updated regulations align with the requirements of companies operating during the Umrah season, which begins after the Hajj season.
