In a significant legal triumph, the General Court in Jeddah has issued a decisive ruling transferring traffic violation fines amounting to SR20,000 from a divorcee's vehicle to her ex-husband's account. The court's decision came after the woman successfully demonstrated his full responsibility for the recorded violations.
According to sources, the female citizen presented her case to the traffic circuit under the General Court, asserting ownership of a vehicle registered in her name but not actively used. The fines, accumulated during the possession of her ex-husband before their divorce, prompted her to demand a transfer of responsibility for the traffic violations.
Supporting her case with compelling evidence, including a witness, a previous driving authorization in the defendant's name, and WhatsApp conversations, the divorcee showcased her ex-husband's culpability. In a remote court session where the defendant failed to attend, the traffic circuit scrutinized the evidence and, in accordance with the Traffic Law and its executive regulations, ruled in favor of transferring the SR20,000 fines to the actual perpetrator - her ex-husband.
The court's ruling, considered final, included a directive for all relevant ministries and government agencies to implement it using all applicable legal means, even if involving coercive force by the police.
Commenting on the verdict, Saudi female lawyer Maysar Al-Jeelani highlighted the efficiency of traffic circuits in addressing cases related to traffic accidents and violations. She emphasized that the Supreme Judicial Council's circular, considering claims under SR50,000 as non-appealable, underscores the swift resolution of such cases within the integrated justice system.
